GENERAL TERMS AND CONDITIONS

FOR ACCESS TO TECHNICAL INFORMATION ON SPARE PARTS FOR INDEPENDENT REPAIRERS

GENERAL

In accordance with the EU Right to Repair Directive (Directive (EU) 2024/1799) (hereinafter: the »Directive«), consumers retain the right to have their products repaired and to freely choose a repairer of their choice, without necessary restrictions. To ensure the effective exercise of this right, manufacturers are required to ensure access to spare parts, repair and maintenance information, or to any software tools, hardware, or similar auxiliary means necessary to perform a repair, for products listed in Annex II of the Directive. The scope of such products includes, in particular (as of this date):

Household washing machines and household washer-dryers,

Household dishwashers,

Refrigerating appliances,

Electronic displays (does not include electronic displays with a screen area ≤ 100 cm², projectors, status displays, control panels, etc.),

Vacuum cleaners,

Household tumble dryers.

As defined in Directive EU 2024/1799, a ‘repairer’ means any natural or legal person who, related to that person’s trade, business, craft, or profession, provides a repair service, including manufacturers and sellers that provide repair services and repair service providers whether independent or affiliated with such manufacturers or sellers.

Disclaimer: The information provided by the manufacturer, including repair services, service conditions, indicative repair prices, labour rates, transport fees and spare-parts prices, applies exclusively to the manufacturer’s authorised repairers and to original spare parts supplied or marketed by the manufacturer. The indicative prices and service conditions are based on the manufacturer’s internal service network and reflect typical practices of authorised repairers only. Independent or non-authorised repairers operate outside the manufacturer’s authorised service network and may apply different pricing structures, labour rates, service conditions, spare parts, and repair methods. The manufacturer does not have access to, nor control over, the pricing, terms or technical processes applied by such independent repairers. Nothing in this information shall be interpreted as limiting the consumer’s right to choose an independent repairer, in accordance with applicable European Union and national “right to repair” legislation. However, repairs carried out by independent repairers are performed under their sole responsibility and may differ in scope, price, duration, and conditions from those described by the manufacturer.

PURPOSE OF TERMS AND CONDITIONS

Terms and Conditions for access to Technical Information (hereinafter: the »Terms«) define the conditions governing access to and use of the Application GSD One-Time access provided by Gorenje gospodinjski aparati, d.o.o., Partizanska cesta 12, 3320 Velenje, acting as a manufacturer or EU-economic operator in regard to the Directive, and an owner and operator (hereinafter: the »Operator«).

The Application GSD One-Time access constitutes an information system designed to provide access to certain information on the repair and maintenance of products, including information on spare parts, technical documentation, and other data necessary for carrying out repairs in accordance with applicable EU legislation (hereinafter: the »Application«).

These Terms are drafted in accordance with applicable EU law as well as relevant national consumer protection legislation. The purpose of these Terms is to define the modalities and conditions of use of the application and access to its content by the User.

The User of the Application is an independent repairer - not affiliated or in a contractual relationship with a manufacturer or a seller - who uses this information system for the purpose of providing repair services within the scope of their trade, business, craft, or profession (hereinafter: the »User«).

By accessing the application, the User confirms that they have read and understood these Terms and unconditionally accepts them in their latest applicable version.

NO BARRIERS TO REPAIR

The Operator may not use contractual clauses, hardware or software measures that would prevent or unjustifiably restrict the User in obtaining repair of products covered by EU “right to repair” legislation.

The Operator shall not impose any restriction that would prevent the use of original or second-hand spare parts, compatible spare parts, or spare parts produced using 3D-printing technologies, provided that such spare parts comply with applicable EU or national legal requirements, including product safety rules and intellectual property laws.

Any limitations on repair-related measures can be applied only where objectively and legitimately justified, for example to ensure product safety or to protect intellectual property rights, and always in compliance with EU and national law.

ACCESS TO TECHNICAL INFORMATION

Registration

The Application is accessible via the Internet network through a computer and/or smartphone and/or a tablet computer. To access the functionalities offered in the Application, the User must first register and create a user account. As part of the registration process, the User is required to provide complete and accurate information, including in particular:

the company name,

email address,

country of establishment,

legal company identity code,

details of the product for which access is requested, including the appliance serial number (S/N).

Operator reserves the right, during the registration process or at any time thereafter, to request additional documentation demonstrating the User’s professional qualification to perform repair services, including but not limited to:

proof of registration with the competent authority and/or

a valid trade or business licence or other relevant authorisation.

Restriction of access

The use of the Application and access to its content shall be conditional upon the User’s full compliance with all provisions of these Terms.

The Operator may, at its sole discretion, restrict, suspend or terminate the User’s access to the Application, either temporarily or permanently, without prejudice to any other rights or remedies that may be exercised by Operator.

Access may be restricted, suspended, or refused only where objectively and legitimately justified, provided that this does not unjustifiably limit the right of the User to carry out repairs in accordance with applicable EU law, including the following circumstances:

in the event of a breach of these Terms by the User,

where the User infringes or is reasonably suspected of infringing intellectual property rights of Operator;

where it has been determined by an independent inspection authority or a court that the User’s conduct results in or poses a risk to product safety;

where there is a substantiated indication that the User has carried out unsafe, improper or unqualified repairs, which may result in significant material damage, personal injury or death, and which may expose the Operator to third-party claims;

where the User misuses the Application, including unauthorized access, unlawful use of technical information, or breach of applicable laws;

where required documentation regarding professional eligibility or compliance with applicable legal requirements is not provided or is found to be inaccurate or misleading.

Interruption of access

The Operator reserves the right to suspend the User’s access to the Application, whether temporarily or permanently, at any time due to technical issues affecting the system supporting the Application, its functionality, or in connection with Application maintenance. Any such suspension shall, where appropriate, be communicated via a notice on the Application homepage or through other suitable means.

PROCESSING OF PERSONAL DATA

At registration, the Operator collects only the basic set of personal data necessary to uniquely identify the system user and to ensure proper system user administration and any related communication. PURCHASE OF SPARE PARTS

THE OPERATOR SHALL NOT BE LIABLE FOR AN INCORRECTLY ORDERED SPARE PART WHERE THE CAUSE OF THE INCORRECT ORDER LIES WITH THE USER. THE USER IS REQUIRED, PRIOR TO PLACING AN ORDER, TO VERIFY THE APPLIANCE MODEL OR ITEM NUMBER AND, ACCORDINGLY, SELECT THE APPROPRIATE SPARE PART.

Original spare parts for products as proposed by the manufacturer due to safety and IP reasons may be purchased through the Operator’s official platform MaintainLife or through other authorised distribution channels.

Spare parts prices

All prices for spare parts are not subject to a predefined period of validity. The Operator reserves the right to change prices unless otherwise stated. The prices displayed are therefore valid at the time the order is placed with an obligation to pay.

INSTALLATION OF SPARE PARTS AND REPAIR RESPONSIBILITY

WHERE INSTALLATION OR REPAIR IS PERFORMED BY THE USER, SUCH ACTIVITIES ARE CARRIED OUT EXCLUSIVELY UNDER THE RESPONSIBILITY AND LIABILITY OF THAT USER. THE OPERATOR AND AFFILIATES SHALL NOT BE LIABLE FOR ANY BODILY INJURY, MATERIAL DAMAGE, MALFUNCTION OR ANY OTHER LOSS RESULTING FROM IMPROPER, UNSAFE OR NON-COMPLIANT INSTALLATION, REPAIR OR USE OF SPARE PARTS.

THE USER IS RESPONSIBLE FOR ENSURING THAT:

THE INSTALLATION OR REPAIR IS PERFORMED WITH THE REQUIRED LEVEL OF PROFESSIONAL SKILL AND CARE;

ALL APPLICABLE LEGAL REQUIREMENTS, INCLUDING PRODUCT SAFETY RULES, ARE COMPLIED WITH;

ONLY SUITABLE AND COMPLIANT SPARE PARTS ARE USED.

WHERE SPARE PARTS ARE ACCOMPANIED BY INSTALLATION INSTRUCTIONS, SUCH INSTRUCTIONS MUST BE FOLLOWED. THE INDEPENDENT REPAIRER REMAINS FULLY RESPONSIBLE FOR ANY DEVIATION FROM SUCH INSTRUCTIONS AND FOR THE CONSEQUENCES THEREOF.

NOTHING IN THESE TERMS SHALL LIMIT THE RIGHT OF INDEPENDENT REPAIRERS TO USE ORIGINAL, SECOND-HAND, COMPATIBLE OR 3D-PRINTED SPARE PARTS, PROVIDED THAT SUCH PARTS COMPLY WITH APPLICABLE LEGAL REQUIREMENTS. HOWEVER, THE USE OF SUCH PARTS AND ANY REPAIR PERFORMED REMAIN UNDER THE SOLE RESPONSIBILITY OF THE USER.

WHERE THE PRODUCT IS STILL COVERED BY A MANUFACTURER’S WARRANTY, THE VALIDITY OF SUCH WARRANTY SHALL BE SUBJECT TO THE CONDITIONS SET OUT IN THE APPLICABLE WARRANTY STATEMENT AND RELEVANT LEGISLATION.

IDEMNIFICATION AND LIABILITY

THE USER ACKNOWLEDGES AND AGREES THAT ALL REPAIR, INSTALLATION, AND SERVICING ACTIVITIES ARE CARRIED OUT UNDER ITS SOLE RESPONSIBILITY AND RISK. ACCORDINGLY, THE USER SHALL FULLY INDEMNIFY, DEFEND AND HOLD HARMLESS THE OPERATOR, ITS AFFILIATES AND THEIR RESPECTIVE DIRECTORS, OFFICERS AND EMPLOYEES FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, ACTIONS, DAMAGES, LOSSES, LIABILITIES, COSTS AND EXPENSES (INCLUDING REASONABLE LEGAL FEES) ARISING OUT OF OR IN CONNECTION WITH:

ANY REPAIR, INSTALLATION OR SERVICING PERFORMED BY THE USER;

ANY DEFECTIVE, IMPROPER, NEGLIGENT OR NON-COMPLIANT REPAIR WORK;

THE USE OF NON-COMPLIANT OR UNSAFE SPARE PARTS;

ANY BREACH OF THESE TERMS OR APPLICABLE LAWS;

ANY INFRINGEMENT OF THIRD-PARTY RIGHTS, INCLUDING INTELLECTUAL PROPERTY RIGHTS.

IN PARTICULAR, THE USER SHALL INDEMNIFY THE OPERATOR, ITS AFFILIATES AND THEIR RESPECTIVE DIRECTORS, OFFICERS AND EMPLOYEES AGAINST ANY CLAIMS BROUGHT BY END CUSTOMERS OR THIRD PARTIES ALLEGING DEFECTIVE REPAIR, MATERIAL DAMAGE, PERSONAL INJURY OR DEATH RESULTING FROM REPAIR SERVICES CARRIED OUT BY THE USER.

THE USER SHALL BE FULLY AND UNLIMITEDLY LIABLE, UNDER BOTH CIVIL AND CRIMINAL LAW, FOR ANY VIOLATION OF THE OPERATOR’S RIGHTS.

INTELLECTUAL PROPERTY

THE USER IS INFORMED THAT TECHNICAL INFORMATION CONTAINED ON THE APPLICATION:

IS PROTECTED BY COPYRIGHT LAWS, IN PARTICULAR WITH RESPECT TO IMAGES, TEXTS, TECHNICAL DOCUMENTATION, DRAWINGS, DIAGRAMS, ANIMATIONS, DATABASES AND SOFTWARE MADE AVAILABLE ON OR THROUGH THE APPLICATION;

IS PROTECTED BY DESIGN RIGHTS LEGISLATION, IN PARTICULAR WITH RESPECT TO THE DESIGN, APPEARANCE AND TECHNICAL CONFIGURATIONS OF HOME APPLIANCES AND THEIR COMPONENTS PRESENTED ON THE APPLICATION;

IS PROTECTED BY TRADEMARK LAWS, IN PARTICULAR WITH RESPECT TO TRADEMARKS, LOGOS AND BRAND ELEMENTS OF OPERATOR AND OTHER RELEVANT MANUFACTURERS OR SUPPLIERS DISPLAYED ON THE APPLICATION;

CONSTITUTES A VALUABLE BODY OF TECHNICAL KNOWLEDGE, KNOW-HOW AND DATA DEVELOPED OR COMPILED BY OPERATOR AND/OR ITS AFFILIATES.

THE USER'S RIGHTS UNDER THESE TERMS ARE STRICTLY LIMITED TO ACCESSING AND CONSULTING THE TECHNICAL INFORMATION MADE AVAILABLE ON THE APPLICATION AND USING IT SOLELY FOR THE MAINTENANCE AND REPAIR OF THE OPERATOR’S APPLIANCES.

ANY UNAUTHORISED USE, REPRODUCTION OR DISTRIBUTION OF THE CONTENT WITHOUT OUR PRIOR WRITTEN CONSENT IS STRICTLY PROHIBITED.

WITHOUT OUR EXPRESS PRIOR WRITTEN CONSENT, IT IS NOT PERMITTED TO MODIFY, PUBLISH, TRANSMIT, SELL, REPRODUCE OR CREATE DERIVATIVE WORKS FROM ANY CONTENT OF OUR APPLICATION.

ANY INFRINGEMENT OF OUR INTELLECTUAL PROPERTY RIGHTS MAY RESULT IN LEGAL PROCEEDINGS BEING INITIATED TO PROTECT OUR RIGHTS.

AGENCY AND AUTHORIZATION

The User acts at all times independently, in its own name and for its own account. Nothing in these Terms shall be construed as creating any authorised service relationship, agency, partnership, joint venture, or other form of legal or commercial affiliation between the User and Operator.

All repair services are performed under the sole responsibility of the User, which shall be exclusively responsible for its relationships with customers and for any services rendered. Operator shall not be liable for, nor deemed to have endorsed or guaranteed, any repair services, representations or results of work performed by the User.

The User shall have no authority whatsoever to act on behalf of Operator, to make any representations, warranties or commitments binding upon Operator, or to present itself as an authorised service provider or otherwise affiliated with Operator. The User shall ensure that its conduct, communications, and commercial practices do not create any such impression.

Any breach of this clauses, including any misrepresentation of authorisation or affiliation with Operator, shall constitute a breach of these Terms and may result in restriction of access to the Application.

XI. APPLICABLE LAW AND DISPUTES

These Terms and any contractual or non-contractual obligations arising out of or in connection with them, shall be governed by and construed in accordance with the laws of the Republic of Slovenia. Any disputes arising out of or in connection with these Terms shall first be resolved amicably between the Operator and User. In the absence of such settlement, they shall be subject to the exclusive jurisdiction of the competent court of Republic of Slovenia.

XII. FINAL PROVISIONS

These Terms shall enter into force on the date of their publication on the website. The Operator reserves the right to amend these Terms without prior notice.
